Testimony on HB 1279 Provided to the Florida House Budget Committee

FPI provided the written comments below to the Florida House Budget Committee on House Bill (HB) 1279.

FPI opposes CS/HB 1279 for its provisions that seek to keep bright immigrants from pursuing higher education in the state. HB 1279 would require Florida’s 12 state universities to cap enrollment for immigrants who are not U.S. citizens or permanent residents from any one country to no more than 5 percent of all nonresident enrollees. Nonresidents can include an array of U.S.-based students, not just immigrants. By targeting nonresidents who lack permanent residency (i.e., green cards) or citizenship, however, HB 1279 would impact a wide array of people — including nonimmigrant visitors, those here on work or student visas, refugees and asylum-seekers, immigrants with temporary protected status, and undocumented immigrants.

Furthermore, starting in 2030, any preeminent research university that fails to adhere to this ban would not be able to receive added state funding if HB 1279 passes. For the 2025-26 fiscal year, four of Florida’s 12 universities received preeminence designation and were each granted $10 million from the state’s general revenue fund. This legislation doubles down and expands upon 2025’s special session bill, SB 2C, which repealed Florida’s 2014 bipartisan in-state tuition law for DREAMers.

FPI opposed the repeal of in-state tuition for young immigrants and warned of its long-term harms to higher education and Florida’s workforce. HB 1279 takes this a concerning step forward by limiting the number of immigrants who can enroll in higher education in Florida altogether. Restricting access to education for such a wide swath of immigrants will only lead to fewer graduates, Florida falling behind in STEM and other higher education goals, and ultimately, a weaker state workforce and economy.

Meanwhile, numerous inclusive bills that recognize immigrants' contributions to Florida and beyond have failed to receive hearings this session. Florida simply cannot compete with a weakened student body and labor force. We urge you to vote no on HB 1279.
